These Terms of Service (“Terms”) govern your access to and use of Answerly(the “Service”), provided as part of the Leximo product family. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Answerly provides an AI-powered phone receptionist that answers calls, speaks with your callers, and books appointments into your connected calendar. Features depend on your plan and may change over time.
2. Eligibility & accounts
You must be at least 18 and able to form a binding contract. You are responsible for activity under your account and for keeping access to your sign-in email secure, since we use passwordless email sign-in links.
3. Subscriptions, billing & cancellation
- Paid plans are billed in advance on a recurring basis (monthly or yearly) through our processor, Stripe.
- Subscriptions renew automatically until cancelled. Prices are in USD and exclude taxes unless stated.
- You can cancel anytime from the billing portal. Cancellation takes effect at the end of the current billing period; when the subscription ends, your assigned phone number and AI assistant are released and deactivated, and the Service stops answering calls.
- Except where required by law, payments are non-refundable. Plan limits (such as included call volumes) apply per plan.
4. Phone numbers & telephony
Phone numbers are provided through our telephony partner and assigned to you for use with the Service. You do not own the number and may lose it if your subscription ends. You agree to use the Service in compliance with all applicable telecommunications laws, including those governing call recording, robocalls, and unsolicited communications (for example, the TCPA in the United States). You are solely responsible for the content of your AI’s greeting and the lawfulness of recording calls in your and your callers’ jurisdictions.
5. Your data & your responsibilities
You are the controller of the personal data your callers provide and that the Service collects on your behalf. You are responsible for providing any legally required notices and obtaining any required consents from your callers, including for recording. Our handling of data is described in our Privacy Policy.
6. Acceptable use
You agree not to use the Service to:
- Break the law or infringe others’ rights;
- Send spam, scams, or unlawful, deceptive, or harassing communications;
- Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service; or
- Misrepresent the AI as a licensed professional or provide regulated advice (legal, medical, financial) through it.
7. AI & no professional advice
The Service uses automated AI that can make mistakes, mishear, or occasionally book or summarize incorrectly. It is provided as a productivity tool, not as professional advice. You should review appointments and important details. We do not guarantee that every call will be answered or every booking will be accurate.
8. Third-party services
The Service relies on third parties (for example, Stripe, Vapi, ElevenLabs, Deepgram, Google, Microsoft, MailerSend, and Mixpanel). Your use of connected services is also subject to their terms, and we are not responsible for their acts or omissions.
9. Intellectual property
We and our licensors own the Service and all related intellectual property. We grant you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing. You retain rights to your own business and customer data.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, Answerly and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amounts you paid us in the 12 months before the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold Answerly harmless from claims arising out of your use of the Service, your content and greetings, your handling of caller data, or your violation of these Terms or applicable law.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or others. Upon termination, your right to use the Service ends and provisioned telephony resources are released.
14. Governing law & changes
These Terms are governed by the laws applicable at our principal place of business, without regard to conflict of laws rules. We may update these Terms from time to time; material changes will be reflected by the “Last updated” date, and continued use after changes means you accept them.
